WhatsApp Business App Brazil Privacy Notice

What does this Notice cover?

This WhatsApp Business App Brazil Privacy Notice (“Notice”) provides additional information for users of the WhatsApp Business App (“Business App”) and applies to personal data processing activities under Brazilian law.

This Notice supplements the WhatsApp Business App Privacy Policy and the WhatsApp Privacy Policy, which applies to the use of the Business App to the extent information relating to its users would be considered personal data processed by WhatsApp as a controller, each under applicable law. The information provided in this Notice explains "How and Why We Process Your Data” with respect to the Business Functions, and applies to users of the WhatsApp Business App in complement of the information provided in the WhatsApp Business App Privacy Policy. For additional information to understand how your information is processed in Messenger App Functionality, please refer to the WhatsApp Privacy Policy, incorporated herein by reference. Any capitalised terms used but not defined in this Notice have the meanings defined in the WhatsApp Business App Privacy Policy and applicable WhatsApp Privacy Policy. If there is any conflict between this Notice and the WhatsApp Business Privacy Policy or applicable WhatsApp Privacy Policy, this Notice will control solely with respect to your use of the Business App and only to the extent of the conflict.

Why And How We Process Your Data:

As detailed below, depending on the circumstances, we may rely on different purposes when processing your data. The categories of information we process will depend on the data you choose to provide and the manner in which you use our Services (which determines the information we collect automatically).

  • provide you with business features and tools; for example to host and manage your catalog, orders and cart;
  • enable you to use optional experiences or business tools provided by third parties;

To ensure safety, security, and integrity of the Business App. We use information we have and apply automated data processing techniques and, in some instances, conduct manual (human) review to:

  • create quality and integrity inferences about businesses using the Business App;
  • secure WhatsApp systems and WhatsApp Business App users’ accounts;
  • fight threats, abuse, or infringement activities; and
  • promote safety, security, and integrity on the WhatsApp Business App and ensure compliance with our terms and policies.

How We Work With Other Meta Companies

WhatsApp is one of the Meta Companies. The Meta Companies provide technology products and services for both individuals and businesses.

Where Meta acts as a service provider for WhatsApp

We work with other Meta Companies that act as our service providers and help us provide, secure and improve our Business App. When Meta Companies act as our service providers, we require them to use your information on our behalf in accordance with our instructions and terms. For more information on how we work with other Meta Companies that act as our service providers generally see the “How We Work With Other Meta Companies” section of the WhatsApp Privacy Policy which applies to you.

Other ways WhatsApp works with Meta

In addition to the information described in the applicable WhatsApp Privacy Policy, WhatsApp also shares information we collect with other Meta Companies.

To enable Meta business tools and features available on the WhatsApp Business App, we share information with the Meta Companies that enable these experiences (as described in the chart above).

The Meta Companies will use this information subject to Meta's Privacy Policy. Learn more about the other Meta Companies and their information practices by reviewing their privacy policies.

How can you exercise your rights under the LGPD?

Under the Brazilian General Data Protection Law (the “LGPD”), you have the right to access, rectify, port, erase, and confirm that we process your data. In certain circumstances, you also have the right to object to and to restrict the processing of your personal data.

You can access or port your information using our in-app Request Account Info feature (available under Settings > Account). You can find a more comprehensive description of what information is included in the report here. You can access tools to rectify, update, and erase your information directly in-app as described in the "Managing and Retaining Your Information" section of the WhatsApp Privacy Policy.

We only rely on your consent under LGPD in limited circumstances. For example, when we collect and use information you allow us to receive through the device-based settings when you enable certain features and services such as access to your GPS location, camera, or photos, so we can provide those features and services. When we process data based on your consent, you have the right to withdraw your consent at any time.

You can delete your WhatsApp account at any time using our in-app Delete My Account feature (available under Settings > Account). When you delete your WhatsApp account, your undelivered messages are deleted from our servers as well as any of your other information we no longer need to operate and provide our Services. Deleting your account will, for example, delete your account info and profile photo, delete you from all WhatsApp groups, and delete your WhatsApp message history. Be mindful that if you only delete the WhatsApp application from your device without using our in-app Delete My Account feature, your information may be stored with us for a longer period. It may take up to 90 days from the beginning of the deletion process to delete your WhatsApp information. Copies of your information may also remain after the 90 days in the backup storage that we use for legitimate purposes or for compliance with legal obligations. Please remember also that when you delete your account, it does not affect your information related to the groups you created or the information other users have relating to you, such as their copy of the messages you sent them.
